TERMS AND CONDITIONS


The booking will be considered confirmed only after initial booking amount is paid.


Documents required :


A guest must have a valid photo ID Proof for booking a domestic Tour and a valid passport for booking an International Tour. As per the circular issued under RBI regulations, submission of PAN and adhar card for international tours is mandatory. If the guest does not possess the documents stated herein, then, in such case, a provisional booking is made and confirmed only after the submission of the said Documents


 Passport

For traveling abroad, all guests including children must be in possession of a machine-readable passport valid for minimum of 180 days (6 months) from their Tour return date along with applicable Visas. Please cross check all particulars of your passport including your name/ address/validity/expiry date and Blank pages for Visas as per requirement.


For few tours we collect your passport and submit to various private entities or consulates on your behalf. During this process if passport gets damaged, we do not hold responsibility and is not liable to pay compensation/ refund/ claim as it does not have direct /indirect control on these authorities.


VISA

For international travel appropriate and applicable visa as per domestic and international government policies is required.


Photo Identification

All guests are advised to carry the photo identification in the form of driving license, election ID card, passport and adhar card and students must carry with them their school / college ID card. At certain sightseeing places, the Identification proof is mandatory required and company has no control over it. The identification documents must be produced by the guests as per the rules and regulations prescribed at different locations. Also, please ensure that on tour you carry the same photo ID submitted in the office. In case of documents being in maiden name, provide & carry those documents.


Immigration

Granting or rejecting the permission to enter a particular country is solely upon the discretion of the immigration authority. Sometimes a guest may be deported/ interrogated/ and may be held back by the immigration authorities for a longer span than the usual time. In such a case, the guest missing out on the itinerary program is not our liability. All the Expenses incurred by guests while they are held back by the immigration authorities or deportation costs would be borne by the guest and we shall not be responsible for any reversals towards the same. In any such cases of deportation/ interrogation/ rejection of permission to enter a particular country by the immigration authorities, the guest is not eligible for any refunds and compensations from us.


 Baggage:

You are responsible for your own baggage. All the risk and responsibility of all your baggage, belongings, currency, valuables, documents and personal effects (collectively ‘baggage’) is on you at all times during the tour, whether during travel on the airline or during your stay in hotel or during your travel in coaches. Please note that Tour Managers are not responsible for your baggage or any kind of personal belongings and we will not be responsible for any cancellation or curtailment of your tour compelled by any such loss of baggage etc. and we shall pay no compensation or refund to you.


-  Please take a note that if your baggage is lost or misplace any time during the course of your tour, it is your responsibility to take all appropriate actions to file complaints with the concerned authorities, including police, airline office etc. You have to understand that the Tour Manager is responsible for the whole group of guests and he may not be in a position to escort you to lodge a complaint with the concerned authorities, as doing so could compromise the convenience and time of the rest of the Guests.


Air / train tickets:

In case of group tours separate air/ train tickets will not be provided. Group tickets will be provided at the time of final meeting along with necessary details and documents like visa and instructions. In case if airlines or railway change or delay anything after booking, we will not be held responsible for it and will not be liable for any refunds.


Regarding itinerary:

All the Itinerary information given at the time of booking or is based on the information available at that time and is subject to change depending on other factors such as Airline, hotel, transport availability, government policies, etc. in case of unavoidable changes the additional cost is to be borne by the guest.


· Sometimes the sightseeing places are changed for betterment of the tour program. We may detour to reach sightseeing places due to traffic conditions; road blocks and that may vary the course of itinerary. If sightseeing timings aren't adhered to, or if any add-ons are required then the same will be borne by the guests.


· The actions, inactions, defaults or condition of tour participants in the group can also result in changed Itinerary.


· We reserve the right to change the departure date or cancel a departure due to unforeseen reasons and will not take any responsibility for your ticket which you may have purchased in advance for Domestic or International Sectors.


· You are responsible for being punctual at all times during the tour. In the event any part of the sightseeing tour is missed by you due to delay on your part, you will not be entitled to claim refund of the same.


· If you are joining or leaving in between of an ongoing tour. Please contact the office to get the proper details and requirements regarding it.




Payment policy:

- Taxes:  GST is mandatory on all trips.-5%


· TCS is mandatory tax applied on all international tours. -5% or 10%(in case supporting documents are not provided by guest )


· In case the guest make Tour payment by cheque and such cheque is dishonored, a charge of ₹150 + 18% GST will be levied by the Company and borne by the guests immediately.


     

· TCS and GST are non refundable.


· The invoice will be provided after completion of trip.


·   TCS certificate will be issued as per government policies.

TERMS & CONDITIONS FOR DOMESTIC & INTERNATIONAL TOURS 

INTERPRETATION:

In these terms & conditions, the following words & expressions shall have the meaning indicated against each: Company We mean SHRI DATTA HOLIDAYS Nashik. Client OR Tour Members means applicant who has been duly enrolled for Domestic/International Tour/Package/booking of SHRI DATTA HOLIDAYS, Nashik.                                                                                                                                                 


01. Application for Domestic & International Tours : Application Google Form shall be duly filled by Applicant & he/she should sign on behalf of other applicants mentioned in the Google Application Form as a sign of accepting Terms & Conditions of the Tour/Package/Booking. The applicant who has signed the application shall be deemed to be responsible and liable for other applicants mentioned in the same form.


02.  Applicant should deposit photocopy of Passports / Aadhar Card /Driving Licence & Vaccination Certificate (May Be RTPCR Negative report within 48/72 as per Central/State Rules) of all co-applicants with Company. The application form will be as contract between SHRI DATTA HOLIDAYS, Nashik and Applicant for Tour


03.  Tour Fees & Payments :


a)   Explanation of certain terminology regarding Tour Fee payable : Twin Sharing : Two persons sharing a two bedded room. Triple Sharing : Three persons sharing three bedded room OR one queen size bed and one extra bed Single Occupancy : Single person in one bedded room. Adult : Person completed 12 years of age & above at the time of journey end date. Child : Person not completed 12 years of age & above at the time of journey end date. Infant : Child not completed 2 years of age & above at the time of journey end date.

b)  Minimum Booking amount will be Rs. 25,000/-per person payable in Cash, by Credit / Debit card, local cheque/D.D. or transferred to Bank Account of Company by NEFT (Bank Charges Applicable to Client )

c)  Balance amount shall be paid 45 Days prior departure date otherwise Company cannot be held liable for change in hotels, airline, tour dates, tour fee and other tour components. Also, Company will be unable to collect /process

/ deliver air tickets & process Visa.

d)  For International Tour: One part of Tour fee will be paid in Indian Rupees and second part of Foreign Currency Eg. USD, Euro will be payable in Indian Rupees at prevailing foreign exchange rate of authorised Forex agent of Company.

e)  Company does not accept any credit terms and all payment must be settled within above mentioned time limit.

f)   The Published tour fee is subject to change due to 1) Cost factor 2) Things beyond our control 3) Time of tour cost calculation and the client should confirm his tour fee at the time of booking.

g)  For payments made by Credit /Debit Card, an additional Service charge is payable, which is levied by Bank on us.

h)   GST / is the additional Tax which should be pay by client. For international tour additional TCS tax must be paid by Client i) Client will have to pay forex currency payment as per RBI guidelines.


04.   Tour Escort Policy :

a) Company is bound to provide a Tour Escort of Company only if there are minimum 15 paying adults in the group. In case of big groups, there will be one tour escort for every 30 tour members. Company may change this policy as per urgency.

b) For client either travelling in a group or individually as per requirement , an Hindi / English speaking local guide or Driver cum licensed guide will accompany during tour on Extra Cost (Strictly Paid at the time of Booking)

c) Tour Escort or the local guide is not bound to accompany during Shopping, Extra sightseeing and any leisure activities, although they will guide Client about information needed.

d)Tour Escort is a dignified professional representative of the Company. He is not bound to cater to any personal demands, and must be treated with dignity. He is authorized to take any suitable decision in the interest of Group for smooth functioning of tour.


05.   Sightseeing :

a) Sightseeing mentioned only in itinerary will be covered in the tour. Although we take optimum care to complete all sightseeing mentioned in itinerary, there could be some unforeseen circumstances beyond our control. In such cases any sightseeing place not covered due to Covid Guidelines or any unavoidable circumstances may not be repeated again. And there will not be any refund for uncovered sightseeing.

b)  Additional sightseeing, Extra Show, Adventure Games which are not mentioned in Tour package will be paid directly in cash by the tour member on Tour. Tour Escort is not bound to accompany during such additional sightseeing.

c) During sightseeing there is predetermined time for departure, arrival and also timing during sightseeing. Guest is expected to follow these timings punctually. As we may be travelling in a group or with other tourists in ‘Seat on Coach System’ during individual package tour, it is our duty that others should not suffer due to few latecomers. If Guest is not able to report within such time, the bus may have to leave such person behind. The Company cannot be held liable for any missed sightseeing or show or any separate transport expense incurred by such latecomer.

d) The sightseeing spots, close enough within easy walking distance will be visited on foot. Company is not bound to make any alternative transport arrangements for such sightseeing.


06.   Visa & Passport :

a) Passport is an individual property thus issuance of new passport or passport renewal will not constitute part of an International Tour conducted by the Company. If any tour applicant does not have VALID passport by any reason at the time of booking, he / she should acquire new / renewed passport in time stipulated by Company. It will be at the own risk of client. Passports having expiry date 6 months before last date of tour to be concluded in India, Passports in mutilated conditions—torn, wet, marked with colour / ink, removal of plastic cover on photo, handwritten passports are some of the cases of Passports NOT VALID. Please confirm it at the time of booking.

b) Passport issuance is totally controlled by Passport Office and local Police Station. Company has no control over the procedure as we only assist for the same. Thus company cannot be blamed for any kind of delay in issuance of passport and its late submission to Company for process of any visa required for Tour.

c) The Company will give the list of documents required to get VISA. The Tour Member should submit all these documents within time schedule stipulated by Company. He / She should also submit additional documents or satisfy any query whenever called by concerned Consulate. Company is not liable if Visa is not issued within sufficient time before departure due to delayed submission of necessary documents by Tour Members

d) Granting of Visa is totally controlled by the Consulate of each Individual Nation. Hence Company is not liable if Visa application is rejected or visa granted late due to any reason or delayed due to process of Consulate . Also, sometimes the applicant is called upon to the Consulate for personal interview. In such case, all expenses arising out of such visit to the consulate are to be borne by the applicant.

e) We are not responsible for any typo error that occur on stamped or paper visa granted by consulate/Embassy regarding name, gender, passport number, photo, duration, no. of entry’s, etc.

f) During any International Tour if any Tour member loses his passport any additional expenses to be incurred to acquire passport or travel document will be paid by Tour Member immediately on tour in cash.

g)  We strongly recommend Domestic / International travel insurance policy with extra cost if not covered in your package (including New Covid Protection.

h) We / Tour Company are not responsible for any rejection due to Post Covid Guidelines.


07.    Food :

a) Breakfast: ( if Include or Mentioned in your tour ) Depending upon the itinerary breakfast will be arranged in Hotel or in other restaurant or sometimes in travelling vessel like flight, bus or train. Apart from in transportation, Breakfast will be unlimited open buffet. OR sometimes as per situations we will provide pack breakfast but the items will be limited.

b) Lunch / Dinner : ( if Include or Mentioned in your tour ) , mostly Company will provide Indian Lunch/ Dinners. Mostly it may be Buffet Lunch/ Dinner. But as some destinations do not have Indian restaurants, local or continental Dinner will be served in Hotel or in Restaurants. Sometime pack lunch/ Dinner which is limited and may be in the form of snacks will be served which will be of substantial quantity. For Individual or family package tours ( if Include or Mentioned in your tour ), lunch and dinner will be provided if it is included in your package.

c) Water : Guests should purchase drinking water at their own cost during to & fro journeys & entire tour. Some restaurants provide complementary drinking water, whereas some charge for it and do not allow outside drinks including water. In such case guests should purchase drinking water at their own cost. Company will arrange Mineral water bottles in Group tour, if it is specified in the Group Package.

d) Menu : ( if Include or Mentioned in your tour ), Company will provide vegetarian and non-vegetarian food. The menu is always pre-decided by restaurant or the local agent. No change in menu will be possible. Anything extra like Cold drink, Juice, Ice-cream should be purchased by guests at their own cost.

e) Bed Tea: ( if Include or Mentioned in your tour ), Bed tea, Coffee or any other drink in the morning or in the afternoon between lunch and dinner is may not provided by the Company. Some hotels have instant tea-coffee maker in the room. Otherwise guests can go to the breakfast venue early to have early morning tea, coffee if possible or bring their own tea / coffee maker and readymade tea / coffee mix sachets with them.

f)  Special Meal: In Domestic / International travel and in an escorted group travel, it is not possible to cater to individual food habits and choices. Thus guests should ensure some provision for their own food for needs like for “Fasting” and Feel up food between lunch and Dinner.

g) Transfers : ( if Include or Mentioned in your tour ), In some places restaurants won’t be accessible by tourist bus due to issues like parking. In these cases if restaurant is at walkable distance, no transport arrangement will be made to lunch or dinner places. In some cases local transport such as Bus, Taxi, MRT, Tram may be used for such meal transfers. For Individual Package tour no transport will be provided to reach restaurant unless specified.

h) Changes : Depending upon the circumstances, we reserve the right to change meal location, restaurant, time & the menu, without prior notification. Tour escort will be authorized to take such decisions upon change in circumstances.

i) We take every effort to provide best food, but taste differs as per individual & hence it should not be associated with quality.


08.    Hotels :

a) Guests cannot check-in before check-in time decided by the hotel/Resort/Farm Stay/ Home Stay. Company is not bound to provide refreshing rooms.

b) Guests are supposed to follow the check-out time. Any charge or penalty for late check-out is be paid by the guest in cash and on the spot directly to hotel/Resort/Farm Stay/ Home Stay.

c) In Domestic / International travel, some destinations do not have porters at Hotel/Resort/Farm Stay/ Home Stay. So you may have to carry your own luggage to the room.

d) Mini-bar bills, telephone bills, laundry bills or any other expense made by guest at hotel during his stay must be settled half an hour before the departure. Company is not liable to pay for any damages caused by the guest.

e) In rare circumstances Company reserves the right to change hotel/Resort/Farm Stay/ Home Stay without prior notice. However the new hotel/Resort/Farm Stay/ Home Stay provided would be equivalent in same category.

f)  Safeguarding room keys is totally client’s responsibility. In case of loss of room keys, guests must pay any penalty if applicable.

g) If client wants superior class of rooms or superior class of hotels, the Company must be informed and additional charges be paid in advance by the guest at the time of booking. Up gradation of higher category room will depend on availability & Extra Cost.

h) We always organize fine quality Hotels/Resorts/Farm Stays/ Home Stays for a pleasant sojourn. But room size, hotel amenities, class and overall staying experience always differs according to destination, locality, season, as well as personal choice and opinion of tour member.

i)   We choose Hotels/Resort/Farm Stay/ Home Stay which are suitable for the tour. But the Company management have no control on operation of the Hotel/Resort/Farm Stay/ Home Stay.

j)  Some Hotels/Resort/Farm Stay/ Home Stay require deposit in local currency at the time of check-in. If you are travelling in Individual or Family package tours, you must make additional provision for such money. You are expected to take receipt of it and collect deposit at the time of check out. Keeping charge on your credit card is one of the alternatives for deposit in cash. But do not advice for the same.

k)  In Individual Tour or Package Company always insist for using authorized stays by the local or central authorities, but the choice of property is as per client, sometimes client insist for specific or type of property, company is not liable for any kind of mischief / misbehavior / theft or any kind of service-related issues happened with the Hotels/Resort/Farm Stay/ Home Stay.


09.   LUGGAGE:

a)  In Domestic /International travel, you have to carry your luggage on own. Porterage expense if any has to be paid by client.

b)   During Domestic / International air travel every person is normally given baggage allowance of 15/20/30 Kg Check-in luggage and 7/15 kg Cabin luggage as per Airline. But for any Air Travel within India or international within country travel by low Cost Airline the baggage allowance is 15 KG only. For travel to some countries like USA, Canada, Australia & UK dimensions of Travel bag are also prescribed or additional baggage allowance is provided. Any more weight or measurement than these limits may attract “excess baggage surcharge” & it must entirely be paid individually by the Client in cash.

c)  We do not guarantee group check in and normally check in will be as per family, which is very convenient & time saving for the Group. Hence group leader is not liable to club baggage.

d)  In case of baggage loss during air travel; suffering tour member must bare all expenses regarding claim of baggage arising thereof like transportation, etc.


10. Transport :

a) All Domestic/International travel will be carried mostly by Air Conditioned vehicles. Tour members must follow instructions given by coach captain and smoking, littering, food & beverage consumption is prohibited during transport. In Jungle Safari ( If include ) most vehicles are non AC.

b)    Clients, who want to upgrade their mode or class of travel (e.g. different airline, separate vehicle, Railway travelling Class etc.) shall intimate the Company and pay the additional charges in advance at the time of booking.

c)  Seating arrangements in bus is depends upon first cum first serve basis OR on rotation basis depending policy of the Company depending on tour by the Central/State/Local Government Norms.

d)    For the International/Domestic Tour/Package Vehicles are Sanitized, Having some guidelines regarding Seat Capacity.


10.    Tickets :

a)  Any Domestic / International air/railway/bus ticket (if) included in Tour Fee is always of Economy/Sleeper class. If you want to travel by Business/First class or First/Second AC Class, you have to pay the difference of fare.

b)          Booking of particular seat in Airline/Rail will depend upon availability and as per policy of Airline/Rail. Sometimes booking of such preferential seat requires additional expenses which is not part of your Tour Price and is to be paid in cash additionally by Tour Member. Booking of particular seats is not part of services of Tour and Company is not liable for not getting particular type of seat demanded by Tour member.

c)      Tour member should give meal preference for International/Domestic travel at the time of booking. Company will book such meals with Airline Company. However provision of meals as per order given is the responsibility of such Airline and Company will not be responsible for any issues arising on this subject because Company has not control over it.

d)       In case your tour booking is not made 60 days before the date of departure of a tour, you may have to pay fare difference if your seats in Airline are not confirmed in same fare class which is included in the Tour Fee. In the Case of Railway the booking should made in advance of 120 Days. (Currently No Concessional Fare available for Some Special Trains)

e)       Currently Company insist to purchase Air Tickets on Corporate Fare in this post covid situation, ( this fare may include with Seat Preference , Minimum Charges for Cancellation & Date Changes) , these fares are slightly high side for cost but giving security to client.

f)       as of now / as per situation Baggage Tag, Health Form & Boarding Pass must be issued & essential to present at the time of Boarding the flight. Company can provide this to client by some extra cost.


11.    Additional Expences : Due to unforeseen circumstances or things beyond the control of company such as cancellation of flight, local political/climatic/pandemic conditions. Or Central/State/Local Guidelines; if any additional stay , route has to be changed or additional vehicle required to be hired or any additional Air, Bus Railway tickets are to be purchased or any other sort of additional expenditure to be incurred, the tour member will liable to pay such additional expenses immediately on demand made by the Company on Tour or in case of Individual or Family package tour by Travel Agent of Company arranging your tour. The Company will not liable to pay for such unfortunate event beyond the control of Company.


12.   Prohibitions : In a individual / group tour, to ensure pleasant and healthy atmosphere Alcoholic Drinks, Smoking, Gambling and any kind of obscenity is strictly prohibited. Possession of any Banned Drugs or Narcotics is a criminal offence in most countries and hence prohibited by the Company. Company / Tour Escort reserves the right to discard such guilty client from the tour. Avoid discussion on political Issues.


13.   Cancellation & Refunds :

a) All services are booked well in advance by the Company, for which part payment is already made. If such bookings are cancelled, penalties are levied upon us. Thus if Client wants to cancel the Tour due to any reason, pre-determined cancellation charges may apply, which are explained further in this clause. Also, cancellation of travel arrangements like Air Tickets, Train Tickets, etc. may generate additional cancellation charges – which will be borne by the Client in addition to following cancellation charges.

b)  If Client wants to cancel the tour, he must give an application in writing OR send e-mail to that effect, along with the original receipt. Cancellation application must be signed by the same person who has signed the Application Form.

c) The Company reserves the right to cancel any tour prior to the departure without giving any reason. In such a case, Company is not liable to grant any compensation, but the 90% amount of Tour Fee received will be refunded by A/C Payee cheque in reasonable time period by Company (Excluded various type of Taxes eg. GST/TCS/Airline Taxes).

d)  Refunds if any, or for cancellation of Tour by Company , Due to Pandemic Situation only Credit Note will be issue for tour fees (Excluding Air/Rail/Bus Fare , Visa) with a Specified Date & Specific Sector, The amount will be paid to the client strictly by A/C Payee cheque or by NEFT in the bank account of Tour Member. Amount will be refunded in Indian Rupees only within 120 days of cancellation tour after deducting Cancellation Charges given below.

e) We need minimum 15 working days for start cancellation process.

f) Tour cost & services are perishable charges. So the tour cost is non-refundable & nontransferable. 

g)  Any changes in tour programmed by client will attract cancellation for previous arrangements as well as charges for revised arrangements.

h)  Company will not bear any cancellation charges for additional services purchased by client other than our regular tour inclusions such as hotel booking, air ticketing, train, cruise, etc. after or before tour, even if company cancels the tour.

i)  Visa / hotel booking / air tickets are interrelated services / Sequential services. In case of any rejection in mentioned services by Consulate/Hotels/ Airlines, then client will have to pay cancellation charges individually for the any services rejected.

j)  Customer has to abide by and pay the cancellation charges as per rule, terms & conditions of different organizations like hotel, airlines, cruise, etc. We will refund the amount only after the receipt of amount from respected organizations.

h) In the pandemic situation Cancellation Charges depends upon the time of Cancellation of the Services & May vary from the normal cancellation charges

Normal Cancellation will be as follows —

Period of days before Departure from the date of cancellation and Cancellation Charges (% of Total Tour Fee) 90 Days OR MORE 15% or Rs. 20,000/- whichever is more + Air ticket cancellation charges


          45 to 90 Days 20% or Rs. 30,000/- whichever is more + Air ticket cancellation charges

          30 to 45 Days 25% or Rs. 35,000/- whichever is more + Air ticket cancellation charges + Visa charges if any

          15 to 30 Days 60% of Total Tour Fee

          05 to 15 Days 80% of Total Tour Fee

          00 to 05 Days 100% (No Refund Applicable) of Total Tour Fee


NOTE -  Total Tour Fee includes Total Tour Fee Agreed to pay including (Rs. + Forex) currency payment like USD Euro given in Tour package and converted in Indian Rs. 14 COMPLAINTS JURISDICTION FOR ANY DISPUTE

a) All disputes subject to Nashik Jurisdiction.

b) Client should inform about the complaints in writing only or by e-mail with proper documentation such as bills, Payment receipts etc. within maximum 15 days of completion of tour.

c) Claims can be settled in case of any complaints only if client submits proper documents to management & only on reasonable grounds. No claim will be entertained without proper documentation.

d) In case of any dispute arising out of performance of this Agreement as mentioned in Application Form and tour package, the disputed matter will be first referred for Award to ARBITRATION COMMITTEE set up by Paryatan Aadhar of which this Company is member. Company & customer both agree to accept AWARD given by ARBITRATION COMMITTEE.


14.    Liability of the Company


a) The custody & responsibility of Passport, Air Tickets and Luggage will be with Tour Members. If it is lost, he/she has to bare all expenses to get duplicate Travel Document or duplicate Air Ticket. The group leader will be available for your guidance but it will not be mandatory for him to accompany every time for the visits to High Commission, Police Station, Airline office etc. All expenses to get duplicate document including Fees and transport charges will be paid by concerned tour member in cash on Tour. Company or Tour Escort will not be in any case liable to pay for these expenses or lend money to the concerned Client.

b)  Company cannot be held liable for incidents beyond our control. Any claims for accident, medical problems suffered during the tour, theft, personal liability etc. will not be entertained. These risks are covered in the Travel Insurance (optional) and shall be settled directly by Client with the Insurance Company. As Insurance is a contract between Insurance Agent and Client, Company is not liable for any claim or rejection of claim arising out of such contract.

c) Company is not liable to pay for any service other than mentioned in Tour Package and agreed by both parties.

d)  Company is not responsible for loss/damage of lives or property (luggage, etc.) of the client due to accident, theft or other such mishaps.

e) Company is not responsible for any local services related to hotel, Transportation Company, restaurants, etc., As we do not have control on local bodies.

f)  Company is not responsible for any kind of losses arising out of performance of airlines/hotels/sightseeing coaches Tour Member will have to pay the charges for the same. We do not have control over such charges levied by them.

g)  Company is not liable for any changes or Cancellation are made due to Pandemic Situation or Government Guidelines changes at last movement or in running tour.

TERMS AND CONDITIONS


The booking will be considered confirmed only after initial booking amount is paid.


Documents required :


A guest must have a valid photo ID Proof for booking a domestic Tour and a valid passport for booking an International Tour. As per the circular issued under RBI regulations, submission of PAN and adhar card for international tours is mandatory. If the guest does not possess the documents stated herein, then, in such case, a provisional booking is made and confirmed only after the submission of the said Documents


 Passport

For traveling abroad, all guests including children must be in possession of a machine-readable passport valid for minimum of 180 days (6 months) from their Tour return date along with applicable Visas. Please cross check all particulars of your passport including your name/ address/validity/expiry date and Blank pages for Visas as per requirement.


For few tours we collect your passport and submit to various private entities or consulates on your behalf. During this process if passport gets damaged, we do not hold responsibility and is not liable to pay compensation/ refund/ claim as it does not have direct /indirect control on these authorities.


VISA

For international travel appropriate and applicable visa as per domestic and international government policies is required.


Photo Identification

All guests are advised to carry the photo identification in the form of driving license, election ID card, passport and adhar card and students must carry with them their school / college ID card. At certain sightseeing places, the Identification proof is mandatory required and company has no control over it. The identification documents must be produced by the guests as per the rules and regulations prescribed at different locations. Also, please ensure that on tour you carry the same photo ID submitted in the office. In case of documents being in maiden name, provide & carry those documents.


Immigration

Granting or rejecting the permission to enter a particular country is solely upon the discretion of the immigration authority. Sometimes a guest may be deported/ interrogated/ and may be held back by the immigration authorities for a longer span than the usual time. In such a case, the guest missing out on the itinerary program is not our liability. All the Expenses incurred by guests while they are held back by the immigration authorities or deportation costs would be borne by the guest and we shall not be responsible for any reversals towards the same. In any such cases of deportation/ interrogation/ rejection of permission to enter a particular country by the immigration authorities, the guest is not eligible for any refunds and compensations from us.


 Baggage:

You are responsible for your own baggage. All the risk and responsibility of all your baggage, belongings, currency, valuables, documents and personal effects (collectively ‘baggage’) is on you at all times during the tour, whether during travel on the airline or during your stay in hotel or during your travel in coaches. Please note that Tour Managers are not responsible for your baggage or any kind of personal belongings and we will not be responsible for any cancellation or curtailment of your tour compelled by any such loss of baggage etc. and we shall pay no compensation or refund to you.


-  Please take a note that if your baggage is lost or misplace any time during the course of your tour, it is your responsibility to take all appropriate actions to file complaints with the concerned authorities, including police, airline office etc. You have to understand that the Tour Manager is responsible for the whole group of guests and he may not be in a position to escort you to lodge a complaint with the concerned authorities, as doing so could compromise the convenience and time of the rest of the Guests.


Air / train tickets:

In case of group tours separate air/ train tickets will not be provided. Group tickets will be provided at the time of final meeting along with necessary details and documents like visa and instructions. In case if airlines or railway change or delay anything after booking, we will not be held responsible for it and will not be liable for any refunds.


Regarding itinerary:

All the Itinerary information given at the time of booking or is based on the information available at that time and is subject to change depending on other factors such as Airline, hotel, transport availability, government policies, etc. in case of unavoidable changes the additional cost is to be borne by the guest.


· Sometimes the sightseeing places are changed for betterment of the tour program. We may detour to reach sightseeing places due to traffic conditions; road blocks and that may vary the course of itinerary. If sightseeing timings aren't adhered to, or if any add-ons are required then the same will be borne by the guests.


· The actions, inactions, defaults or condition of tour participants in the group can also result in changed Itinerary.


· We reserve the right to change the departure date or cancel a departure due to unforeseen reasons and will not take any responsibility for your ticket which you may have purchased in advance for Domestic or International Sectors.


· You are responsible for being punctual at all times during the tour. In the event any part of the sightseeing tour is missed by you due to delay on your part, you will not be entitled to claim refund of the same.


· If you are joining or leaving in between of an ongoing tour. Please contact the office to get the proper details and requirements regarding it.




Payment policy:

- Taxes:  GST is mandatory on all trips.-5%


· TCS is mandatory tax applied on all international tours. -5% or 10%(in case supporting documents are not provided by guest )


· In case the guest make Tour payment by cheque and such cheque is dishonored, a charge of ₹150 + 18% GST will be levied by the Company and borne by the guests immediately.


     

· TCS and GST are non refundable.


· The invoice will be provided after completion of trip.


·   TCS certificate will be issued as per government policies.


TERMS & CONDITIONS FOR DOMESTIC & INTERNATIONAL TOURS 

INTERPRETATION:

In these terms & conditions, the following words & expressions shall have the meaning indicated against each: Company We mean SHRI DATTA HOLIDAYS Nashik. Client OR Tour Members means applicant who has been duly enrolled for Domestic/International Tour/Package/booking of SHRI DATTA HOLIDAYS, Nashik.                                                                                                                                                 


01. Application for Domestic & International Tours : Application Google Form shall be duly filled by Applicant & he/she should sign on behalf of other applicants mentioned in the Google Application Form as a sign of accepting Terms & Conditions of the Tour/Package/Booking. The applicant who has signed the application shall be deemed to be responsible and liable for other applicants mentioned in the same form.


02.  Applicant should deposit photocopy of Passports / Aadhar Card /Driving Licence & Vaccination Certificate (May Be RTPCR Negative report within 48/72 as per Central/State Rules) of all co-applicants with Company. The application form will be as contract between SHRI DATTA HOLIDAYS, Nashik and Applicant for Tour


03.  Tour Fees & Payments :


a)   Explanation of certain terminology regarding Tour Fee payable : Twin Sharing : Two persons sharing a two bedded room. Triple Sharing : Three persons sharing three bedded room OR one queen size bed and one extra bed Single Occupancy : Single person in one bedded room. Adult : Person completed 12 years of age & above at the time of journey end date. Child : Person not completed 12 years of age & above at the time of journey end date. Infant : Child not completed 2 years of age & above at the time of journey end date.

b)  Minimum Booking amount will be Rs. 25,000/-per person payable in Cash, by Credit / Debit card, local cheque/D.D. or transferred to Bank Account of Company by NEFT (Bank Charges Applicable to Client )

c)  Balance amount shall be paid 45 Days prior departure date otherwise Company cannot be held liable for change in hotels, airline, tour dates, tour fee and other tour components. Also, Company will be unable to collect /process

/ deliver air tickets & process Visa.

d)  For International Tour: One part of Tour fee will be paid in Indian Rupees and second part of Foreign Currency Eg. USD, Euro will be payable in Indian Rupees at prevailing foreign exchange rate of authorised Forex agent of Company.

e)  Company does not accept any credit terms and all payment must be settled within above mentioned time limit.

f)   The Published tour fee is subject to change due to 1) Cost factor 2) Things beyond our control 3) Time of tour cost calculation and the client should confirm his tour fee at the time of booking.

g)  For payments made by Credit /Debit Card, an additional Service charge is payable, which is levied by Bank on us.

h)   GST / is the additional Tax which should be pay by client. For international tour additional TCS tax must be paid by Client i) Client will have to pay forex currency payment as per RBI guidelines.


04.   Tour Escort Policy :

a) Company is bound to provide a Tour Escort of Company only if there are minimum 15 paying adults in the group. In case of big groups, there will be one tour escort for every 30 tour members. Company may change this policy as per urgency.

b) For client either travelling in a group or individually as per requirement , an Hindi / English speaking local guide or Driver cum licensed guide will accompany during tour on Extra Cost (Strictly Paid at the time of Booking)

c) Tour Escort or the local guide is not bound to accompany during Shopping, Extra sightseeing and any leisure activities, although they will guide Client about information needed.

d)Tour Escort is a dignified professional representative of the Company. He is not bound to cater to any personal demands, and must be treated with dignity. He is authorized to take any suitable decision in the interest of Group for smooth functioning of tour.


05.   Sightseeing :

a) Sightseeing mentioned only in itinerary will be covered in the tour. Although we take optimum care to complete all sightseeing mentioned in itinerary, there could be some unforeseen circumstances beyond our control. In such cases any sightseeing place not covered due to Covid Guidelines or any unavoidable circumstances may not be repeated again. And there will not be any refund for uncovered sightseeing.

b)  Additional sightseeing, Extra Show, Adventure Games which are not mentioned in Tour package will be paid directly in cash by the tour member on Tour. Tour Escort is not bound to accompany during such additional sightseeing.

c) During sightseeing there is predetermined time for departure, arrival and also timing during sightseeing. Guest is expected to follow these timings punctually. As we may be travelling in a group or with other tourists in ‘Seat on Coach System’ during individual package tour, it is our duty that others should not suffer due to few latecomers. If Guest is not able to report within such time, the bus may have to leave such person behind. The Company cannot be held liable for any missed sightseeing or show or any separate transport expense incurred by such latecomer.

d) The sightseeing spots, close enough within easy walking distance will be visited on foot. Company is not bound to make any alternative transport arrangements for such sightseeing.


06.   Visa & Passport :

a) Passport is an individual property thus issuance of new passport or passport renewal will not constitute part of an International Tour conducted by the Company. If any tour applicant does not have VALID passport by any reason at the time of booking, he / she should acquire new / renewed passport in time stipulated by Company. It will be at the own risk of client. Passports having expiry date 6 months before last date of tour to be concluded in India, Passports in mutilated conditions—torn, wet, marked with colour / ink, removal of plastic cover on photo, handwritten passports are some of the cases of Passports NOT VALID. Please confirm it at the time of booking.

b) Passport issuance is totally controlled by Passport Office and local Police Station. Company has no control over the procedure as we only assist for the same. Thus company cannot be blamed for any kind of delay in issuance of passport and its late submission to Company for process of any visa required for Tour.

c) The Company will give the list of documents required to get VISA. The Tour Member should submit all these documents within time schedule stipulated by Company. He / She should also submit additional documents or satisfy any query whenever called by concerned Consulate. Company is not liable if Visa is not issued within sufficient time before departure due to delayed submission of necessary documents by Tour Members

d) Granting of Visa is totally controlled by the Consulate of each Individual Nation. Hence Company is not liable if Visa application is rejected or visa granted late due to any reason or delayed due to process of Consulate . Also, sometimes the applicant is called upon to the Consulate for personal interview. In such case, all expenses arising out of such visit to the consulate are to be borne by the applicant.

e) We are not responsible for any typo error that occur on stamped or paper visa granted by consulate/Embassy regarding name, gender, passport number, photo, duration, no. of entry’s, etc.

f) During any International Tour if any Tour member loses his passport any additional expenses to be incurred to acquire passport or travel document will be paid by Tour Member immediately on tour in cash.

g)  We strongly recommend Domestic / International travel insurance policy with extra cost if not covered in your package (including New Covid Protection.

h) We / Tour Company are not responsible for any rejection due to Post Covid Guidelines.


07.    Food :

a) Breakfast: ( if Include or Mentioned in your tour ) Depending upon the itinerary breakfast will be arranged in Hotel or in other restaurant or sometimes in travelling vessel like flight, bus or train. Apart from in transportation, Breakfast will be unlimited open buffet. OR sometimes as per situations we will provide pack breakfast but the items will be limited.

b) Lunch / Dinner : ( if Include or Mentioned in your tour ) , mostly Company will provide Indian Lunch/ Dinners. Mostly it may be Buffet Lunch/ Dinner. But as some destinations do not have Indian restaurants, local or continental Dinner will be served in Hotel or in Restaurants. Sometime pack lunch/ Dinner which is limited and may be in the form of snacks will be served which will be of substantial quantity. For Individual or family package tours ( if Include or Mentioned in your tour ), lunch and dinner will be provided if it is included in your package.

c) Water : Guests should purchase drinking water at their own cost during to & fro journeys & entire tour. Some restaurants provide complementary drinking water, whereas some charge for it and do not allow outside drinks including water. In such case guests should purchase drinking water at their own cost. Company will arrange Mineral water bottles in Group tour, if it is specified in the Group Package.

d) Menu : ( if Include or Mentioned in your tour ), Company will provide vegetarian and non-vegetarian food. The menu is always pre-decided by restaurant or the local agent. No change in menu will be possible. Anything extra like Cold drink, Juice, Ice-cream should be purchased by guests at their own cost.

e) Bed Tea: ( if Include or Mentioned in your tour ), Bed tea, Coffee or any other drink in the morning or in the afternoon between lunch and dinner is may not provided by the Company. Some hotels have instant tea-coffee maker in the room. Otherwise guests can go to the breakfast venue early to have early morning tea, coffee if possible or bring their own tea / coffee maker and readymade tea / coffee mix sachets with them.

f)  Special Meal: In Domestic / International travel and in an escorted group travel, it is not possible to cater to individual food habits and choices. Thus guests should ensure some provision for their own food for needs like for “Fasting” and Feel up food between lunch and Dinner.

g) Transfers : ( if Include or Mentioned in your tour ), In some places restaurants won’t be accessible by tourist bus due to issues like parking. In these cases if restaurant is at walkable distance, no transport arrangement will be made to lunch or dinner places. In some cases local transport such as Bus, Taxi, MRT, Tram may be used for such meal transfers. For Individual Package tour no transport will be provided to reach restaurant unless specified.

h) Changes : Depending upon the circumstances, we reserve the right to change meal location, restaurant, time & the menu, without prior notification. Tour escort will be authorized to take such decisions upon change in circumstances.

i) We take every effort to provide best food, but taste differs as per individual & hence it should not be associated with quality.


08.    Hotels :

a) Guests cannot check-in before check-in time decided by the hotel/Resort/Farm Stay/ Home Stay. Company is not bound to provide refreshing rooms.

b) Guests are supposed to follow the check-out time. Any charge or penalty for late check-out is be paid by the guest in cash and on the spot directly to hotel/Resort/Farm Stay/ Home Stay.

c) In Domestic / International travel, some destinations do not have porters at Hotel/Resort/Farm Stay/ Home Stay. So you may have to carry your own luggage to the room.

d) Mini-bar bills, telephone bills, laundry bills or any other expense made by guest at hotel during his stay must be settled half an hour before the departure. Company is not liable to pay for any damages caused by the guest.

e) In rare circumstances Company reserves the right to change hotel/Resort/Farm Stay/ Home Stay without prior notice. However the new hotel/Resort/Farm Stay/ Home Stay provided would be equivalent in same category.

f)  Safeguarding room keys is totally client’s responsibility. In case of loss of room keys, guests must pay any penalty if applicable.

g) If client wants superior class of rooms or superior class of hotels, the Company must be informed and additional charges be paid in advance by the guest at the time of booking. Up gradation of higher category room will depend on availability & Extra Cost.

h) We always organize fine quality Hotels/Resorts/Farm Stays/ Home Stays for a pleasant sojourn. But room size, hotel amenities, class and overall staying experience always differs according to destination, locality, season, as well as personal choice and opinion of tour member.

i)   We choose Hotels/Resort/Farm Stay/ Home Stay which are suitable for the tour. But the Company management have no control on operation of the Hotel/Resort/Farm Stay/ Home Stay.

j)  Some Hotels/Resort/Farm Stay/ Home Stay require deposit in local currency at the time of check-in. If you are travelling in Individual or Family package tours, you must make additional provision for such money. You are expected to take receipt of it and collect deposit at the time of check out. Keeping charge on your credit card is one of the alternatives for deposit in cash. But do not advice for the same.

k)  In Individual Tour or Package Company always insist for using authorized stays by the local or central authorities, but the choice of property is as per client, sometimes client insist for specific or type of property, company is not liable for any kind of mischief / misbehavior / theft or any kind of service-related issues happened with the Hotels/Resort/Farm Stay/ Home Stay.


09.   LUGGAGE:

a)  In Domestic /International travel, you have to carry your luggage on own. Porterage expense if any has to be paid by client.

b)   During Domestic / International air travel every person is normally given baggage allowance of 15/20/30 Kg Check-in luggage and 7/15 kg Cabin luggage as per Airline. But for any Air Travel within India or international within country travel by low Cost Airline the baggage allowance is 15 KG only. For travel to some countries like USA, Canada, Australia & UK dimensions of Travel bag are also prescribed or additional baggage allowance is provided. Any more weight or measurement than these limits may attract “excess baggage surcharge” & it must entirely be paid individually by the Client in cash.

c)  We do not guarantee group check in and normally check in will be as per family, which is very convenient & time saving for the Group. Hence group leader is not liable to club baggage.

d)  In case of baggage loss during air travel; suffering tour member must bare all expenses regarding claim of baggage arising thereof like transportation, etc.


10. Transport :

a) All Domestic/International travel will be carried mostly by Air Conditioned vehicles. Tour members must follow instructions given by coach captain and smoking, littering, food & beverage consumption is prohibited during transport. In Jungle Safari ( If include ) most vehicles are non AC.

b)    Clients, who want to upgrade their mode or class of travel (e.g. different airline, separate vehicle, Railway travelling Class etc.) shall intimate the Company and pay the additional charges in advance at the time of booking.

c)  Seating arrangements in bus is depends upon first cum first serve basis OR on rotation basis depending policy of the Company depending on tour by the Central/State/Local Government Norms.

d)    For the International/Domestic Tour/Package Vehicles are Sanitized, Having some guidelines regarding Seat Capacity.


10.    Tickets :

a)  Any Domestic / International air/railway/bus ticket (if) included in Tour Fee is always of Economy/Sleeper class. If you want to travel by Business/First class or First/Second AC Class, you have to pay the difference of fare.

b)          Booking of particular seat in Airline/Rail will depend upon availability and as per policy of Airline/Rail. Sometimes booking of such preferential seat requires additional expenses which is not part of your Tour Price and is to be paid in cash additionally by Tour Member. Booking of particular seats is not part of services of Tour and Company is not liable for not getting particular type of seat demanded by Tour member.

c)      Tour member should give meal preference for International/Domestic travel at the time of booking. Company will book such meals with Airline Company. However provision of meals as per order given is the responsibility of such Airline and Company will not be responsible for any issues arising on this subject because Company has not control over it.

d)       In case your tour booking is not made 60 days before the date of departure of a tour, you may have to pay fare difference if your seats in Airline are not confirmed in same fare class which is included in the Tour Fee. In the Case of Railway the booking should made in advance of 120 Days. (Currently No Concessional Fare available for Some Special Trains)

e)       Currently Company insist to purchase Air Tickets on Corporate Fare in this post covid situation, ( this fare may include with Seat Preference , Minimum Charges for Cancellation & Date Changes) , these fares are slightly high side for cost but giving security to client.

f)       as of now / as per situation Baggage Tag, Health Form & Boarding Pass must be issued & essential to present at the time of Boarding the flight. Company can provide this to client by some extra cost.


11.    Additional Expences : Due to unforeseen circumstances or things beyond the control of company such as cancellation of flight, local political/climatic/pandemic conditions. Or Central/State/Local Guidelines; if any additional stay , route has to be changed or additional vehicle required to be hired or any additional Air, Bus Railway tickets are to be purchased or any other sort of additional expenditure to be incurred, the tour member will liable to pay such additional expenses immediately on demand made by the Company on Tour or in case of Individual or Family package tour by Travel Agent of Company arranging your tour. The Company will not liable to pay for such unfortunate event beyond the control of Company.


12.   Prohibitions : In a individual / group tour, to ensure pleasant and healthy atmosphere Alcoholic Drinks, Smoking, Gambling and any kind of obscenity is strictly prohibited. Possession of any Banned Drugs or Narcotics is a criminal offence in most countries and hence prohibited by the Company. Company / Tour Escort reserves the right to discard such guilty client from the tour. Avoid discussion on political Issues.


13.   Cancellation & Refunds :

a) All services are booked well in advance by the Company, for which part payment is already made. If such bookings are cancelled, penalties are levied upon us. Thus if Client wants to cancel the Tour due to any reason, pre-determined cancellation charges may apply, which are explained further in this clause. Also, cancellation of travel arrangements like Air Tickets, Train Tickets, etc. may generate additional cancellation charges – which will be borne by the Client in addition to following cancellation charges.

b)  If Client wants to cancel the tour, he must give an application in writing OR send e-mail to that effect, along with the original receipt. Cancellation application must be signed by the same person who has signed the Application Form.

c) The Company reserves the right to cancel any tour prior to the departure without giving any reason. In such a case, Company is not liable to grant any compensation, but the 90% amount of Tour Fee received will be refunded by A/C Payee cheque in reasonable time period by Company (Excluded various type of Taxes eg. GST/TCS/Airline Taxes).

d)  Refunds if any, or for cancellation of Tour by Company , Due to Pandemic Situation only Credit Note will be issue for tour fees (Excluding Air/Rail/Bus Fare , Visa) with a Specified Date & Specific Sector, The amount will be paid to the client strictly by A/C Payee cheque or by NEFT in the bank account of Tour Member. Amount will be refunded in Indian Rupees only within 120 days of cancellation tour after deducting Cancellation Charges given below.

e) We need minimum 15 working days for start cancellation process.

f) Tour cost & services are perishable charges. So the tour cost is non-refundable & nontransferable. 

g)  Any changes in tour programmed by client will attract cancellation for previous arrangements as well as charges for revised arrangements.

h)  Company will not bear any cancellation charges for additional services purchased by client other than our regular tour inclusions such as hotel booking, air ticketing, train, cruise, etc. after or before tour, even if company cancels the tour.

i)  Visa / hotel booking / air tickets are interrelated services / Sequential services. In case of any rejection in mentioned services by Consulate/Hotels/ Airlines, then client will have to pay cancellation charges individually for the any services rejected.

j)  Customer has to abide by and pay the cancellation charges as per rule, terms & conditions of different organizations like hotel, airlines, cruise, etc. We will refund the amount only after the receipt of amount from respected organizations.

h) In the pandemic situation Cancellation Charges depends upon the time of Cancellation of the Services & May vary from the normal cancellation charges

Normal Cancellation will be as follows —

Period of days before Departure from the date of cancellation and Cancellation Charges (% of Total Tour Fee) 90 Days OR MORE 15% or Rs. 20,000/- whichever is more + Air ticket cancellation charges


          45 to 90 Days 20% or Rs. 30,000/- whichever is more + Air ticket cancellation charges

          30 to 45 Days 25% or Rs. 35,000/- whichever is more + Air ticket cancellation charges + Visa charges if any

          15 to 30 Days 60% of Total Tour Fee

          05 to 15 Days 80% of Total Tour Fee

          00 to 05 Days 100% (No Refund Applicable) of Total Tour Fee


NOTE -  Total Tour Fee includes Total Tour Fee Agreed to pay including (Rs. + Forex) currency payment like USD Euro given in Tour package and converted in Indian Rs. 14 COMPLAINTS JURISDICTION FOR ANY DISPUTE 

a) All disputes subject to Nashik Jurisdiction.

b) Client should inform about the complaints in writing only or by e-mail with proper documentation such as bills, Payment receipts etc. within maximum 15 days of completion of tour.

c) Claims can be settled in case of any complaints only if client submits proper documents to management & only on reasonable grounds. No claim will be entertained without proper documentation.

d) In case of any dispute arising out of performance of this Agreement as mentioned in Application Form and tour package, the disputed matter will be first referred for Award to ARBITRATION COMMITTEE set up by Paryatan Aadhar of which this Company is member. Company & customer both agree to accept AWARD given by ARBITRATION COMMITTEE.


14.    Liability of the Company


a) The custody & responsibility of Passport, Air Tickets and Luggage will be with Tour Members. If it is lost, he/she has to bare all expenses to get duplicate Travel Document or duplicate Air Ticket. The group leader will be available for your guidance but it will not be mandatory for him to accompany every time for the visits to High Commission, Police Station, Airline office etc. All expenses to get duplicate document including Fees and transport charges will be paid by concerned tour member in cash on Tour. Company or Tour Escort will not be in any case liable to pay for these expenses or lend money to the concerned Client.

b)  Company cannot be held liable for incidents beyond our control. Any claims for accident, medical problems suffered during the tour, theft, personal liability etc. will not be entertained. These risks are covered in the Travel Insurance (optional) and shall be settled directly by Client with the Insurance Company. As Insurance is a contract between Insurance Agent and Client, Company is not liable for any claim or rejection of claim arising out of such contract.

c) Company is not liable to pay for any service other than mentioned in Tour Package and agreed by both parties.

d)  Company is not responsible for loss/damage of lives or property (luggage, etc.) of the client due to accident, theft or other such mishaps.

e) Company is not responsible for any local services related to hotel, Transportation Company, restaurants, etc., As we do not have control on local bodies.

f)  Company is not responsible for any kind of losses arising out of performance of airlines/hotels/sightseeing coaches Tour Member will have to pay the charges for the same. We do not have control over such charges levied by them.

g)  Company is not liable for any changes or Cancellation are made due to Pandemic Situation or Government Guidelines changes at last movement or in running tour.
